эк. тр., юр. арбитраж последнего предложения* (стороны сделки делают свои окончательные предложения о цене сделки и арбитр должен выбрать одно из этих предложений и не имеет права выбирать какие-л. промежуточные решения; данный арбитраж используется в ситуации, когда обе стороны не могут самостоятельно договориться о цене и при этом промедление с заключением сделки обойдется дорого сторонам или обществу; поскольку арбитру неизвестны реальные факторы, которые ограничивают поведение обеих сторон, перед вынесением решения обе стороны имеют возможность объяснить свои позиции арбитру; секрет механизма заключается в том, что если арбитр будет выбирать промежуточную цену, покупатель будет заинтересован в занижении своего предложения, а продавец в завышении своего, что побудит их соответствующим образом аргументировать свои предложения; но если судья должен выбрать одно из двух предложений, каждая сторона будет опасаться, что ее аргументация и предложения будут выглядеть более нереальными или более несправедливыми и судья выберет вариант другой стороны, что, очевидно, будет серьезным поражением в условиях; поэтому каждая сторона предлагает вариант цены, который находится очень близко к ее реальным возможностям; идею данного механизма предложил в 1966 г.
